Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and SwiftBill Store Management System ("we," "us," or "our") regarding your use of our point-of-sale and store management software (the "Service").
By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Service.
Definitions
"Service"
Refers to the SwiftBill SaaS Platform software, including web application, mobile applications, APIs, and all related services and features.
"Store Owner"
The individual or business entity that subscribes to and has primary administrative control over a store instance in our Service.
"Authorized User"
Any individual granted access to the Service by a Store Owner, including employees, managers, and other designated personnel.
"Store Data"
All information, content, and data entered into or generated by the Service, including but not limited to product information, sales data, and customer records.
Eligibility and Account Registration
Eligibility Requirements
- You must be at least 18 years old or the age of majority in your jurisdiction
- You must have the legal capacity to enter into binding agreements
- You must be authorized by a Store Owner to access the Service
- You must not be prohibited from using the Service under applicable laws
Account Registration
- You must provide accurate, current, and complete information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately of any unauthorized use of your account
- You are responsible for all activities that occur under your account

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY TO YOU IS LIMITED. WE PROVIDE THE SERVICE "AS IS" WITHOUT WARRANTIES OF ANY KIND.
IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA.

Termination
Termination by You
You may terminate your account at any time by contacting us or using the account deletion feature in the Service. Upon termination, your access will cease immediately.
Termination by Us
We may terminate or suspend your access immediately, without prior notice, for:
- Violation of these Terms
- Illegal or fraudulent activity
- Non-payment of fees
- Extended period of inactivity
Data Retention After Termination
After termination, we will retain your Store Data for 30 days to allow for potential reactivation. After this period, data may be permanently deleted. You can request data export during this grace period.
Governing Law and Disputes
Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
Dispute Resolution
- We encourage resolving disputes through direct communication first
- If informal resolution fails, disputes will be subject to binding arbitration
- Arbitration will be conducted under the rules of the Indian Arbitration Act
- Each party will bear their own costs unless awarded otherwise
Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Updating the "Last updated" date at the top of these Terms
- Sending you an email notification
- Displaying a prominent notice in the "Service"
- Requiring your acceptance for continued use
Your continued use of the Service after changes become effective constitutes your acceptance of the new Terms.
